I. GENERAL CONDITIONS

The online store located at www.avita.pl enables shopping via the Internet. It is operated by AVITA Sławomir Rutz, with its registered office at Leśna 40, 86-031 Osielsko, entered in the register of business activity records kept by the Mayor of Bydgoszcz under no. 94354, with the identification numbers NIP 554-046-26-00 and REGON 093065866.

The prices of goods sold in the online store are provided in Polish zlotys or euros, depending on the chosen language. Registered retail customers see gross prices (including VAT). Business customers are assigned net prices (excluding VAT).

Registration in the online store constitutes acceptance of these Terms and Conditions. The user thereby agrees to receive information necessary for order fulfillment to the email address provided.

We make every effort to ensure that the provided photos and descriptions are accurate and complete. However, the photos are for reference only — their color, format, size, or label may differ from the final product. In case of any doubts or to obtain additional information, please contact our Sales Department. The presented product catalog does not constitute an offer within the meaning of the Civil Code and serves solely informational purposes.
II. PROCEDURE FOR SUBMISSION OF ORDERS

Purchase of goods takes place through:

User registration (first time only; subsequent orders after logging in)

Indicating the delivery address

Accepting the Terms of Service

Each order will be confirmed electronically and, in special cases, by phone. The customer has the right to withdraw the order until a store employee confirms shipment.

Orders can be placed 24 hours a day, all year round.

In case of unavailability of the ordered goods or an unexpected delay, the customer will be informed by the Customer Service Department.

Incorrectly completed forms and orders not confirmed within 5 days will not be processed.

The store reserves the right to refuse an order at any stage if the goods are unavailable or in cases raising justified concerns, or if these Regulations are violated.

Due to factors beyond our control (e.g. stock shortages), orders may be fulfilled partially. In such cases, the buyer will be notified immediately.

An invoice will be issued for the ordered goods.

Registered users who give their consent will receive commercial information about products, services, and special offers.
III. ORDER FULFILLMENT

The purchased goods will be delivered by the carrier at the buyer’s expense.

Goods are delivered to the address indicated in the order form.

Orders are shipped and delivered only on business days.

Shipments are delivered via the carrier chosen by the buyer or seller. Delivery time depends on the destination country.

To determine the approximate delivery time, please contact the Avita Export Department.

The company is not responsible for delays caused by the carrier.
IV.a TRANSPORT COSTS WITHIN POLAND

Transport costs include packaging and shipping.

For orders exceeding 2000 zł net, shipping is free (covered by AVITA).

AVITA reserves the right to modify transport costs in special cases (e.g. non-standard packaging or courier restrictions).

Any change in transport costs will be communicated to the customer before shipment.
IV.b TRANSPORT COSTS WORLDWIDE

Transport costs are borne by the buyer.

Upon request, Avita can arrange transport and add the costs to the buyer’s invoice. Customs clearance in Poland can also be organized upon request or as specified in the contract.

International transport costs include packaging and shipping.
-
Transport costs are calculated individually depending on size, weight, and destination country.
V. COLLECTION OF GOODS

The courier delivers packages to the indicated address. If the recipient is absent, a notice will be left specifying the redelivery date and pickup location. Unclaimed parcels will be returned to AVITA. Redelivery is possible after covering the return costs.

Upon receipt, the customer must check the condition and packaging of the shipment. AVITA’s tape is white with a red logo and must not show damage. Complaints require a “Complaint Report” written in the courier’s presence.

If damage or tampering is visible, do not accept the parcel or note it on the CMR and complete a damage report with the courier. Complaints are only accepted with this report.

Complaints for mechanical damage without a proper report or original packaging will not be considered.

Acceptance without reservation constitutes acknowledgment of delivery without damage or loss.
VI. PAYMENT

The customer may choose one of the following payment methods:
• Bank Transfer – the customer pays the total value of the order to the bank account number provided on the proforma invoice. -
The cost of transport is added to the proforma invoice after order acceptance.

When making a transfer, please enter the order number in the payment title.

VII. PRINCIPLES OF COMPLAINT PROCEDURE

In the case of a warranty claim, please:
a) sign the warranty card with your full name,
b) attach a note describing the damage,
c) attach proof of purchase (copy acceptable),
d) send the goods at your own expense to:

We do not accept parcels sent at our expense.

The date of complaint submission is the day the parcel arrives at AVITA’s headquarters.

Complaints will be considered within 30 days. A written response with justification and appeal information will be provided.

Unjustified complaints or damages caused by the user are at the customer’s cost.

For quantity or service complaints, please specify the item and disputed amount.
VIII. ORDER CANCELLATION AND RETURN POLICY

Orders may be canceled without reason until the shipment confirmation message is sent to the buyer.
IX. ADDITIONAL PROVISIONS

If multiple orders are placed within two days and the first has not yet been shipped, we can combine them into one parcel (if possible) and charge shipping once.

Orders can be modified via email or phone before being packed or shipped.

The user may share their account with third parties at their own risk. Personal data must be updated immediately after any change. Data deletion requests can be made by email to kierownik@avita.pl or by phone at +48 52 320 00 00.
